Jammu Kashmir Article 370 Revoked by Indian Parliament

Special Status of Jammu and Kashmir Article 370 has been dismissed by Indian Parliament.

Article 370 specifies that except for defence, foreign affairs, communications and matters specified in the Instrument of Accession of Jammu and Kashmir, the Parliament needs the state government's ratification for all other laws.

On 3 April 2018, the Supreme Court of India gave a similar opinion declaring that the Article 370 has acquired a permanent status. It stated that, since the State Constituent Assembly has ceased to exist, the President of India would not be able to fulfil the mandatory provisions required for its abrogation.

Article 370, which has been the bone of contention between the state's politicians and the central BJP leadership, deals with special powers conferred upon the state of Jammu & Kashmir. It allows the state constituent Assembly to make its own Constitution, thereby giving it an “autonomous state” power.

It is not possible to revoke Article 370 and there are firm constitutional and technical grounds for that. ... Nariman, observed that “it is impossible to abrogate Article 370 of the Constitution, conferring special status on Jammu and Kashmir, because it has acquired permanent status through [its] years of existence.”
